Terms of Service Agreement (Affiliate Program)

By signing up to be an Affiliate in the ARCHIES ATTIRE Affiliate Program (“Program”), you agree to be bound by the following Terms and Conditions (“Agreement”).

ARCHIES ATTIRE reserves the right to update and modify these Terms at any time without prior notice. Continued participation in the Program constitutes acceptance of any changes.

Violation of any terms below may result in termination of your account and forfeiture of any unpaid commissions.

1. Eligibility & Account Terms

You must be 18 years or older to participate.
You must be a resident of India.
You must be a real person. Automated or bot-created accounts are strictly prohibited.
You must provide your legal full name, valid email address, phone number, and any required details during registration.
One person or legal entity may maintain only one affiliate account.
Login credentials cannot be shared.
You are responsible for maintaining the security of your account.
You may not use the Program for any unlawful purpose.
You may not earn commission on purchases made for personal use through your own affiliate link.

2. Affiliate Links & Promotion

After approval, you will receive a unique Affiliate Link.

All tracking will be done through your assigned special affiliate link.
Commission will only be paid on sales tracked through the official system.
You must not modify, manipulate, or misuse tracking links.
Affiliate links must directly promote relevant product pages.
You may promote through:
- Social media
- Website/blog
- WhatsApp marketing (lawful only)
- Email marketing (in compliance with Indian law)

ARCHIES ATTIRE reserves the right to disqualify commissions generated through:

Spam
Fake orders
Self-purchases
Misleading marketing
Fraudulent activity

3. Commission Structure

Affiliates will earn 1% commission on the net sale value (excluding shipping, taxes, refunds, cancellations).
Commission will only be credited after successful payment and completion of return period.
Cancelled or refunded orders will not qualify for commission.

4. Payment & Withdrawal Policy

Commission earnings will accumulate in your affiliate account dashboard.
Minimum withdrawal amount: ₹5000 (Five Thousand Rupees).
Withdrawal requests below ₹5000 will not be processed.
Payments will be processed after verification within 7–15 working days.
If your account never reaches ₹5000, the commission will remain pending and unpaid.

ARCHIES ATTIRE reserves the right to hold payments in case of suspicious activity.

5. Customer Ownership

Customers referred through affiliate links become customers of ARCHIES ATTIRE. All policies regarding pricing, shipping, returns, refunds, and customer service are governed by ARCHIES ATTIRE.

Prices and product availability may change at any time without notice.

6. Affiliate Responsibilities

You are solely responsible for:

Managing and maintaining your promotional platforms.
Ensuring content is truthful and not misleading.
Ensuring your marketing does not violate any third-party rights.
Complying with applicable Indian laws.
Disclosing that you are an Affiliate of ARCHIES ATTIRE where required.

7. Prohibited Activities

You may NOT:

Run paid ads using ARCHIES ATTIRE brand name without written permission.
Claim to represent or be part of ARCHIES ATTIRE.
Offer unofficial discounts or coupon codes.
Engage in spam marketing.
Create fake traffic or manipulate sales.

Violation may result in immediate termination and forfeiture of earnings.

8. Term & Termination

This Agreement begins upon acceptance into the Program and continues until terminated.

Either party may terminate the Agreement at any time.

Upon termination:

All affiliate links must be removed immediately.
Pending commissions below ₹5000 will not be paid.
Verified earnings above ₹5000 will be paid after review.

9. Relationship of Parties

You are an independent contractor. This Agreement does not create any partnership, agency, employment, or joint venture relationship.

You have no authority to bind ARCHIES ATTIRE in any manner.

10. Limitation of Liability

ARCHIES ATTIRE shall not be liable for any indirect, special, or consequential damages arising in connection with the Affiliate Program.

Total liability shall not exceed the total commission amount payable to the Affiliate.

11. Disclaimers

ARCHIES ATTIRE makes no guarantees regarding:

Earnings potential
Continuous website availability
Error-free tracking
Sales volume

Participation is at your own risk.

12. Governing Law & Jurisdiction

This Agreement shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts located in Ajmer, Rajasthan.

13. Arbitration

Any dispute shall first be attempted to be resolved amicably. If unresolved, disputes may be referred to arbitration under applicable Indian law. The seat of arbitration shall be Ajmer, Rajasthan.
